Terms and Conditions

Open Love is a service provided by Klikkracht B.V., registered with the Dutch Chamber of Commerce (KvK) under number 91303281, hereinafter referred to as "Open Love", "we" or "us". These terms and conditions apply to any use of the Open Love website and application (hereinafter: the "Service").

Open Love is exclusively focused on connecting adults within the context of ethical non-monogamy (ENM): relationship structures based on mutual consent, honesty, and openness. Open Love is explicitly not a platform for offering, requesting, or facilitating paid sexual services, escort services, or comparable forms of sexual services in exchange for payment, nor does it facilitate these.

By creating an account or using the Service, you agree to these terms and conditions.

Article 1. Definitions

In these terms, the following definitions apply:

Service: the Open Love website and/or application, including all functionalities.
User: any natural person who creates an account and/or uses the Service.
Account: the personal profile created by a user to use the Service.
Subscription: paid access to (additional) functionalities of the Service.
Content: all text, images, photos, and other information a user posts or shares via the Service.

Article 2. Applicability

2.1 These terms and conditions apply to every agreement between Open Love and the user.

2.2 Open Love may amend these terms from time to time. In the event of material changes, we will inform users in advance by email or via a notice within the Service. Continued use after a change constitutes acceptance of the amended terms.

2.3 In addition to these terms and conditions, the Community Guidelines (Appendix 1), the Acceptable Use Policy (AUP), and the privacy policy (Article 11) apply, and form an integral part of this agreement.

Article 3. Registration and account

3.1 To use the Service, you create an account with accurate, current, and complete information.

3.2 You are responsible for keeping your login details confidential and for all activity that takes place through your account.

3.3 One person may create only one account. Creating an account on behalf of, or for, someone else is not permitted.

3.4 Open Love reserves the right to refuse, suspend, or delete an account if the information provided proves to be incorrect, or in the event of a violation of these terms or the Community Guidelines.

Article 4. Age and self-declaration

4.1 The Service is intended exclusively for individuals aged 18 and older.

4.2 Upon registration, the user explicitly declares that they are 18 years of age or older. Open Love does not perform additional identity verification, but reserves the right to suspend or delete an account in the event of a strong suspicion of misuse or a false declaration.

4.3 It is not permitted to use the Service if you are under 18 years of age. Violation of this will result in immediate removal of the account.

Article 5. Subscriptions, payment, and renewal

5.1 Open Love offers various subscription types. Current prices, durations, and terms are stated on the website and may be amended by Open Love at any time. Price changes do not apply retroactively to a payment period that has already commenced and has not yet expired.

5.2 Payment is made via the payment methods offered on the website, processed by an external payment provider.

5.3 A subscription is automatically renewed for one month at a time after the agreed period ends, unless the user has cancelled the subscription in time. Cancellation is possible at any time via the account and takes effect at the end of the current payment period.

5.4 A lifetime subscription provides access to the Service for as long as Open Love exists as a platform. If the Service is discontinued in its entirety, for example due to the cessation of business operations, access under lifetime subscriptions also lapses, without entitlement to a refund, unless mandatory law provides otherwise.

5.5 In the event of late payment, Open Love may suspend access to paid functionalities until payment has been received.

Article 6. Right of withdrawal

6.1 As a consumer, when concluding a subscription online, you generally have the right to withdraw from the agreement within 14 days without giving reasons (right of withdrawal), in accordance with the statutory provisions of Book 6 of the Dutch Civil Code.

6.2 Upon registration, you can indicate that you want the Service to begin immediately, even within the 14-day cooling-off period. By agreeing to this, you acknowledge that, in the event of withdrawal within this period, you will owe an amount proportional to the part of the Service already provided to you at the time of withdrawal.

6.3 Withdrawal can be reported in writing or by email via info@openlove.nl.

Article 7. Use of the Service and rules of conduct

7.1 The user undertakes to use the Service in a respectful and honest manner, in accordance with the Community Guidelines set out in Appendix 1.

7.2 It is not permitted to use the Service for commercial purposes, advertising, solicitation for other platforms or services, or any form of spam.

7.3 Users engage with other users, both within and outside the Service, on their own initiative and at their own responsibility. Open Love always advises users to exercise caution when sharing personal information and when arranging meetings in the physical world.

Article 8. Prohibited content

8.1 It is not permitted to post content that:

contains sexually explicit profile content, including nudity or pornographic images or text;
involves child sexual exploitation or abuse (CSAE) in any form, including content that sexualizes, exploits, or endangers minors;
depicts, promotes, or threatens sexual violence or non-consensual sexual acts, including the non-consensual sharing of intimate images;
facilitates human trafficking or sex trafficking, including offering paid sexual services such as prostitution or escort services;
constitutes a scam or fraudulent activity intended to deceive or defraud other users;
glorifies or incites violence;
is hateful, discriminatory, or offensive towards individuals or groups;
infringes the rights of third parties, including copyright and image rights;
contains advertising or commercial expressions.

8.2 Open Love reserves the right to remove content that violates this article, without prior notice.

Article 9. Moderation, reporting, and suspension

9.1 The Service has a reporting function and a panic button that users can use to report inappropriate behavior, content, or accounts.

9.2 Reports are reviewed through a combination of automated systems and human moderation.

9.3 If a report gives cause to do so, Open Love may suspend an account immediately, pending further investigation. In the event of a confirmed violation of these terms or the Community Guidelines, the account may be permanently deleted.

9.4 Open Love handles reports confidentially and carefully, with particular attention to the discretion that is important within our community.

Article 10. Intellectual property

10.1 All intellectual property rights in the Service, including the software, design, and the Open Love brand name, belong to Klikkracht B.V.

10.2 By posting content on the Service, the user grants Open Love a non-exclusive, worldwide right to use this content, to the extent necessary for the functioning and provision of the Service, for example to show your profile to other users.

Article 11. Privacy and data processing

11.1 Open Love attaches great importance to protecting your personal data, partly in view of the sensitive nature of our target audience. We process personal data in accordance with the General Data Protection Regulation (GDPR).

11.2 We collect and process, among other things, the following data: account data, profile data, photos and other content you post, communications via the Service, and payment data (where applicable).

11.3 Personal data is shared, only to the extent necessary, with:

payment providers, for the purpose of processing payments;
hosting providers, for the purpose of technical management and data storage;
development partners, for the purpose of maintaining and further developing the Service;
marketing channels, for the purpose of communication and outreach, only if and to the extent you have given consent for this or it is necessary for the performance of the agreement.

11.4 Open Love enters into data processing agreements with all parties with whom data is shared, where legally required.

11.5 Open Love does not retain data for longer than necessary for the purposes for which it was collected, or as required by law.

11.6 Given the nature of our community, we handle the confidentiality of profile information with extra care. Profiles are, in principle, only visible to other registered users, not to the public internet or search engines.

11.7 You have the right to access, correct, have deleted, or restrict the processing of your data. Requests to this effect can be directed to info@openlove.nl.

Article 12. Liability

12.1 Open Love makes every effort to provide the Service as well and as safely as possible, but does not guarantee that the Service will be available at all times without errors or interruptions.

12.2 Open Love is not liable for the conduct of users towards one another, including but not limited to conduct during or after meetings arranged through the Service, whether online or offline.

12.3 Open Love is not liable for the accuracy of information provided by users, as no identity verification takes place.

12.4 To the extent permitted by law, Open Love's liability is limited to the amount the user concerned has paid to Open Love in the twelve months preceding the event giving rise to the damage.

12.5 This limitation does not apply in the event of intent or deliberate recklessness on the part of Open Love.

Article 13. Termination

13.1 A user may delete their account at any time via the account settings or by sending a request to info@openlove.nl.

13.2 Open Love may terminate an account in the event of a violation of these terms or the Community Guidelines, or if continuation of the agreement cannot reasonably be required of Open Love.

13.3 Upon termination, the right of access to the Service lapses. Amounts already paid will not be refunded, except as provided in Article 6 (right of withdrawal) or to the extent mandatory law provides otherwise.

Article 14. Amendment of the terms

14.1 Open Love may unilaterally amend these terms and conditions. Changes will be communicated by email or via a notice within the Service, with a reasonable period before the change takes effect.

14.2 If a user does not agree with a change, they may cancel the subscription in accordance with Article 5.3.

Article 15. Disputes and applicable law

15.1 These terms and conditions and all agreements with Open Love are governed exclusively by Dutch law.

15.2 In the event of a dispute, the user will first make an effort to reach a solution together with Open Love, by contacting info@openlove.nl. Open Love strives to respond to complaints within a reasonable period.

15.3 If the parties are unable to reach an agreement, the dispute will be submitted to the competent court of the District Court of Oost-Brabant, location 's-Hertogenbosch, unless mandatory consumer law prescribes a different competent court.

Article 16. Final provisions

16.1 If any provision of these terms proves to be null and void or voidable, the remaining provisions will remain in full force. The parties will replace the void provision with a provision that most closely approximates the original intent.

16.2 These terms have been drawn up in Dutch. In the event of translation into another language, the Dutch text prevails.

Appendix 1: Community Guidelines

Open Love is a platform for and by people from the ENM community. We want to create an environment in which everyone feels safe, respected, and at ease. The guidelines below apply to all users.

Respect and discretion

Treat other members with respect, even if a match or conversation does not go as hoped.
Discretion comes first with us. Never share screenshots, profile information, or conversations of other members outside the Service without their explicit consent.
Respect the boundaries and pace of others. Unwanted or overbearing advances will not be tolerated.

What is allowed

Be honest about who you are and what you are looking for, whether that is a relationship, friendship, or something else.
Use real, recent photos of yourself.
Share your story and be open about your situation, to the extent you are comfortable doing so.

What is not allowed

No photos containing nudity or sexually explicit images.
No child sexual exploitation or abuse (CSAE), or any content involving minors in any way whatsoever.
No content depicting or promoting sexual violence or non-consensual sexual acts, and no sharing of intimate images of others without their consent.
No facilitating human trafficking or sex trafficking, including offering, requesting, or facilitating paid sexual services such as prostitution or escort services.
No scams, fraud, or attempts to deceive or financially defraud other members.
No content that contains or glorifies violence, hatred, or discrimination.
No advertising, spam, or commercial solicitation.
No fake profiles or profiles that do not fit the target audience.
No intimidation, unwanted boundary-crossing behavior, or threats.

Reporting and safety

Use the reporting function or the panic button if you encounter inappropriate behavior or content.
Reports are handled seriously and confidentially by our moderation team, supported by automated screening.
In the event of serious violations, an account may be suspended immediately, pending further investigation.

Outside the app

Be careful about sharing personal information, such as your full name, address, or employer, before you know someone well.
For a first meeting, preferably arrange to meet in a public place and let someone you trust know where you are.
Open Love is not present at meetings between members and cannot guarantee their safety. Rely on your own judgment and boundaries.
